EU Customs Territory

Definition

The EU customs territory is the area where uniform EU customs regulations apply, including the Union Customs Code and the Common Customs Tariff. It comprises the land territories of the 27 EU Member States, their territorial waters, inland waters, and airspace. The definition of the customs territory is set out in Art. 4 of Regulation 952/2013 (UCC).

Not all territories of Member States are part of the customs territory. Exclusions include: Mount Athos (Greece), the Canary Islands (partially), Ceuta and Melilla (Spain), certain French overseas departments, and the Aaland Islands (Finland) for certain provisions. Conversely, Monaco is treated as part of France's customs territory, and San Marino as part of Italy's.

Goods brought into the EU customs territory from third countries are subject to customs supervision and must be placed under a customs procedure. Only after release for free circulation do they acquire EU customs status and can circulate freely throughout the EU internal market without further customs formalities. Understanding the boundaries of the customs territory is essential for correctly applying customs procedures and determining when a customs debt arises.
