Marine propulsion engines - Outboard motors

Classification of outboard motors (8407 21)

Subheading 8407 21 of the Combined Nomenclature covers outboard motors with spark ignition designed for the propulsion of boats and small watercraft. Outboard motors are complete propulsion units mounted on the transom, comprising engine, gearbox, drive shaft, and propeller. Typical outputs range from 2 to 350 HP. They may be two-stroke or four-stroke, fuelled by petrol. The key criterion is the outboard design (transom mounting) and waterborne propulsion purpose. Inboard marine engines are classified under 8407 29. Classification follows GRI rules 1 and 6.

Emission regulations and import requirements for outboard motors

Outboard motors under subheading 8407 21 are subject to Regulation (EU) 2016/1628 (NRMM) and Directive 2013/53/EU (RCD) on recreational craft setting exhaust and noise requirements. CE marking is required under RCD. Import requires an EORI number, customs declaration, declaration of conformity, CE marking, and emission test documentation. EMC Directive 2014/30/EU applies to electronic systems.

Customs duties and the outboard motor market (8407 21)

MFN duty rates should be verified in TARIC. The EU market is dominated by Yamaha, Honda, Suzuki, Tohatsu, and Mercury Marine. Preferential rates may be available under FTA (EPA with Japan). Chapter 84 products are not subject to CBAM. Import VAT is charged. Current rates should be verified in TARIC.

Frequently asked questions

What emission regulations apply to outboard motors in the EU?
Outboard motors are subject to Directive 2013/53/EU (RCD) setting emission limits for CO, HC, NOx, and particulates, and Regulation (EU) 2016/1628 (NRMM). Staged emission limits have applied since 2006. Non-compliant engines cannot be placed on the EU market. CE marking is mandatory.
Do outboard motors require CE marking?
Yes. Outboard motors for the EU market must bear CE marking under Directive 2013/53/EU (RCD). The manufacturer must issue an EU declaration of conformity. Conformity assessment includes exhaust emission and noise testing with a notified body.
How does an outboard motor differ from an inboard engine?
An outboard motor (8407 21) is a complete propulsion unit mounted on the transom with engine, gearbox, and propeller in one unit. An inboard engine (8407 29) is mounted inside the hull and drives the shaft through a clutch. The criterion is mounting method: outboard vs. inboard.
