Definition
Conditional release of goods occurs when customs releases goods into circulation before all requirements are met, imposing on the importer an obligation to fulfil conditions within a specified period. This is commonly applied when laboratory test results, conformity certificates, import permits, or other required documents are pending.
The condition for release is the lodging of a guarantee covering potential duty differences or ensuring goods are not marketed until requirements are met. Under Article 194 UCC, customs releases goods when conditions for the procedure are met or security is provided.
