Definition und Umfang der Unterposition 8517 62 — Netzwerkgeraete
Die Unterposition 8517 62 umfasst Geräte zum Empfang, zur Umwandlung und zum Senden oder zur Regenerierung von Sprache, Bildern oder anderen Daten, einschließlich Vermittlungs- und Leitweglenkungsgeraete. Der Umfang schliesst Netzwerkrouter, Ethernet-Switches, DSL-, Kabel- und Glasfasermodems, WDM-Multiplexer, VoIP-Gateways, Medienkonverter und WiFi-Zugangspunkte ein. Das wesentliche Einreihungskriterium ist die Funktion der Verarbeitung und Weiterleitung von Telekommunikationssignalen. Server werden unter Position 8471 eingereiht. Basisstationen unter 8517 61. PBX-Anlagen ebenfalls unter 8517 62.
Regulatorische Anforderungen für Netzwerkgeraete
Netzwerkgeraete mit Funkmodul unterliegen der RED. Rein kabelgebundene Geräte unterliegen LVD und EMV. CE-Kennzeichnung ist erforderlich. RoHS 2 beschraenkt gefaehrliche Stoffe. WEEE 2 erfordert Registrierung. Netzwerkgeraete können NIS2-Cybersicherheitsanforderungen unterliegen. CBAM gilt nicht. Geräte mit Verschluesselung können Dual-Use-Exportkontrollvorschriften unterliegen.
Zollsätze und ITA für Netzwerkgeraete
MFN-Zollsätze in TARIC prüfen. Netzwerkgeraete profitieren als Telekommunikations- und IT-Produkte vom ITA-Nullzoll. Wichtige Hersteller: Cisco, Juniper, Arista, Huawei, ZTE, Nokia. Erforderliche Unterlagen: Handelsrechnung, Befoerderungsdokumente, EORI, CE-Konformitätserklärung, RoHS und WEEE-Daten. Nationale MwSt. wird erhoben.
RED-Richtlinie und Telekommunikationsgeräte 8517 62
Telekommunikationsgeräte unter 8517 62 unterliegen der RED 2014/53/EU, wenn sie Funkwellen senden oder empfangen. Ab 2025 benötigen Smartphones und Tablets USB-C. MFN-Zollsatz: 0% (ITA). Geräte müssen LVD, EMV und RoHS 2 erfüllen. Die Cybersicherheit vernetzter Geräte regelt der Cyber Resilience Act (EU) 2024/2847.
